Standing Instructions
Standing Instructions (“SI”) is a new facility offered by Tata Sky to its subscribers to recharge their Tata Sky account.
All Tata Sky subscribers (hereinafter referred to as “You”) who avail of the SI facility shall be bound by the following terms and conditions:
Definitions
“Active account status” means a positive Account Balance in your Subscriber Account.
“SI facility” means the standing instructions facility wherein you have authorized Tata Sky to debit your bank account/charge your credit card for an amount of Rs.500 toward recharge of your Subscription Account every time your Account Balance falls below the SI Minimum Balance.
“SI Minimum Balance” means a minimum Account Balance of Rs 200 in your Subscriber Account.
Terms used herein but not defined shall have the same meaning assigned to them in the Subscription Contract signed between You and Tata Sky.
The SI facility
- In order to activate the SI facility on your Subscriber Account, You are required to authorize Tata Sky and the authorized service provider for Tata Sky to either debit your bank account or charge your credit card by submitting a SI authorization form to Tata Sky. In order to be eligible for the SI facility, You must provide your own bank account/credit card details.
- Your SI facility shall be activated within a maximum period of 4 weeks after the processing and validation of your SI authorization form and supporting documents (as listed below) by Tata Sky and Your Bank. You shall provide the documents mentioned below along with your SI authorization form.
- For SI facility-Direct debit to your Bank account
- Blank Cancelled cheque displaying Your bank account number.
- SI Authorization form in triplicate duly completed and signed.
- For SI facility-Charge to your credit card
- Copy of Your credit card – Only front of the card
- SI Authorization form in triplicate duly completed and signed.
- Till the time your SI facility is activated, You must recharge your Subscriber Account through the various other recharge methods available to You in order to avoid deactivation of your Tata Sky services on account of insufficient Account Balance. Under no circumstances You shall be entitled to any refund or credit adjustments in the event Your recharge of your Subscriber Account coincides with the approval of your SI facility on account of which your Subscriber Account gets topped up twice.
- In case, You submit an incomplete SI authorization form, You shall be contacted by Tata Sky for the missing details/documents. In the event, Tata Sky is unable to establish contact with You for any reason, Your SI authorization form shall be rejected.
- Upon activation of your SI facility, your bank account shall be debited or your credit card shall be charged depending upon your chosen SI for a standard recharge of Rs 500 every time your Account Balance falls below Rs 200.
This recharge process will be completed within 10 working days and the credit of Rs 500 will be reflected in your Subscriber Account thereafter. Notwithstanding what is stated above, Tata Sky assumes no liability whatsoever for any delay or failure in the amount of Rs.500 being credited to your Subscriber Account and consequent deactivation of your Subscriber Account on account of insufficient Account Balance where such delay or failure is solely attributable to your Bank or any other reason whatsoever. In such an event, You shall be required to recharge your Subscriber Account through the various other recharge methods available in order to prevent deactivation of your Tata Sky services.
- You will receive an alert on your television screen confirming that your Subscriber Account has been recharged. You can access your Account Statement online from the “My Tata Sky” section of www.tatasky.com
- Tata Sky will not be responsible if Your SI authorization form has been rejected during the process of verification and validation for any reason whatsoever.
- Your SI facility will be valid till the earlier of the following:
- Termination of your Tata Sky Service.
- Withdrawal of the SI facility by Tata Sky.
- Cancellation of the SI facility by You by serving 30 days written notice.
- Rejection of your SI by Your Bank/Credit card issuer for any reason whatsoever.
- As per the revised guidelines from Reserve Bank of India, the attempts due to failure have been brought down to 1 or 2 attempts depending on the failure reason - technical or non technical.
- Technical Failures - will include failures such as
- Account Closed
- No Such Account
- Account Description Does not Tally
- ECS Mandate Not Received
- Miscellaneous
These failures will be highlighted at the first failure itself and the SI Mandate shall stand suspended. Once resolved, the restriction will be lifted off the record, after which the records will get processed successfully.
- Non-Technical Failures - include failures with reasons such as
- Insufficient Balance
- Not Arranged For
- Payment Stopped by Drawer
- Payment Stopped under Court Order
These failures will be highlighted at the second consecutive failure and SI Mandate shall stand suspended.
- Tata Sky shall not be responsible for any fraudulent or disputed transactions. In case of a dispute regarding the transaction through bank/credit card the same must be resolved by You directly with Your Bank or Credit Card Issuer. You will not make Tata Sky a party to any such dispute and Tata Sky shall not be liable to You for any consequence arising out of the fraudulent or disputed transactions.
- An administrative fee of Rs 30 will be deducted from Your Tata Sky account in the event your SI transaction is rejected for the following reasons:
- Insufficient Balance
- Funds not arranged for/Exceeds arrangement
- Tata Sky reserves the right at anytime, without prior notice, to add or vary all or any of these terms and conditions or to replace, wholly or in part the SI facility or to withdraw it completely.
- Any request made by You towards amending the SI facility for reasons for change of Bank or Credit card will result in complete cancellation of the SI facility & will require You to re-register for the SI facility.
- The SI authorization form is available through authorized Tata Sky Engineers & also as a PDF file on the Tata Sky website: www.tatasky.com on the self care portal – under Account Recharge section. For activation or cancellation of the SI facility, You must mail the SI authorization form in triplicate alongwith the necessary documents at the following address: Tata Sky Ltd. – Auto Debit Request, PO Box 2424, Bangalore 560024
In the event there are 3 back to back continuous incidences of rejections to the SI by your Bank or credit card issuer, Tata Sky shall the right to levy a penalty &/or revoke the SI facility altogether.
- By signing up for the SI facility, You hereby agree to comply with these terms and conditions and waive any right to claim ambiguity in these terms and conditions and release, indemnify and hold harmless Tata Sky and its respective affiliates, advertising and promotion agencies, and all of its respective agents, representatives, officers, directors, shareholders and employees (collectively, "releases") from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from your use of the SI facility.
- You acknowledge and agree that all disputes in relation to the SI facility shall be determined in the sole and absolute discretion of Tata Sky and that such a decision by Tata Sky shall be final and binding.
