Cheeni Kum Contest

Terms and Conditions

1. “Active account status” means a positive account balance in your Subscriber Account.
2. “Valid entry” means a code sent via sms by You in the correct prescribed format.

Contest shall start at 10:00 hours on 13 November 2009 and close at 23:59 hours on 15 November 2009.

Eligibility

1. The Contest is open ONLY to Tata Sky subscribers who have subscribed to the Lifestyle Gold Pack or the Mega Pack.
2. The following persons cannot participate in this Contest:
3. Employees of Tata Sky and their relatives;
4. Tata Sky business associates including its dealers and advertising agencies and
5. Anyone else who may be involved with the Contest.
6. Tata Sky reserves the right, at any time, to verify eligibility requirements, in any manner deemed appropriate. Only a Valid entry with correct answers to the questions will be eligible for selection for the prize.
7. You must (i) be a resident of India (ii) be above 18 years of age (iii) have a valid PAN card and (iv) have a Subscriber Account with an Active account status to qualify and participate in the Contest.

1. The Contest features one question. To participate in the Contest, You must answer the question. Upon answering the question, a code will be generated on your TV screen. You must send this code by sms to 56633.
2. From the pool of correct entries received for the Contest, one winner will be selected nationally via a computer generated selection process under the supervision of a special panel. The final winner selected for the Contest shall be determined in the sole discretion of Tata Sky.
3. A participant can win only once during the Contest Period.
4. The results generated will be final and binding.

1. The prize for the Contest shall be one Berg Tandoor.
2. The prize is not exchangeable for cash or any other offer.
3. The winner shall be contacted via phone at the phone number mentioned in the Tata Sky records.
4. Tata Sky shall also send a letter to the winner at the address mentioned in the Tata Sky records requesting for a list of documents to be presented by the winner to claim the prize. Non-submission of necessary documents shall lead to disqualification of the winner and an alternative winner shall be chosen thereafter.
5. If Tata Sky is not able to contact the winner at the phone number or the address as mentioned in the Tata Sky records by midnight seven days after Tata Sky 's first attempted notification, Tata Sky reserves the right to select an alternative winner and the original winner's entitlement to the prize will lapse.
6. The prize will be sent by courier within 30 working days from the date of receipt of the documents requested for, from the winner.
7. Tata Sky shall not be liable for any defect or deficiency in the prize or for damage caused to the prize during delivery or for delayed delivery. You acknowledge that the prizes are provided on an “as is basis”.

1. You may send as many entries as you wish.
2. You must send your entry by sms to 56633.
3. SMS rates will be applicable as per the tariff of Your mobile service provider.
4. Participation fees of Rs 10 shall be charged to your Tata Sky Subscriber account for each Valid entry sent.
5. SMS entries for the Contest sent after the closure of the Contest will not be considered.
6. The payment of the prize shall be subject to deduction of applicable withholding taxes as per Indian Income Tax Laws.
7. The winner will be responsible for any other relevant taxes arising from the receipt of the prize. You agree to indemnify Tata Sky against any claims incurred by Tata Sky on account of failure on your part to discharge your tax liabilities with respect to the prize.
8. Any participant who manipulates the Contest in any manner whatsoever shall be liable for disqualification at the sole discretion of Tata Sky. In such an event Tata Sky shall not be liable to consider even a Valid entry sent by the subscriber thereafter.
9. Tata Sky reserves the right at anytime, without prior notice, to add or vary all or any of these terms and conditions or to replace, wholly or in part this Contest or to withdraw it completely.
10. Tata Sky will have the right to use the image of the winners in any promotional material. By entering the Contest, You agree that in the event you are selected as the winner, You shall participate in any promotional activity(ies) and/or have Your name and likeness featured in any promotional material as Tata Sky may require.
11. Tata Sky will not be liable for any loss, damage or cancellation of this Contest caused by events beyond its reasonable control including war, natural calamities, floods, failure of telecommunication network, etc.
12. You consent to comply with these terms and conditions and waive any right to claim ambiguity in these terms and conditions and release, indemnify and hold harmless Tata Sky and its respective affiliates, advertising and promotion agencies, and its respective agents, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from participation in the Contest including but not limited to any use or misuse of the prize by the winner.
13. You acknowledge and agree that all disputes in relation to the Contest shall be subject to Delhi jurisdiction.
14. Tata Sky is not responsible for printing or typographical errors in any Contest related materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error.
15. The Contest is void where prohibited or restricted by law, and is subject to all applicable mandatory national, state and local laws.
