"Be a Topper" Contest

Terms and Conditions

1. “Active account status” means a positive account balance in your Subscriber Account.
2. “Valid entry” means a code sent via sms by You in the correct prescribed format as displayed on Your Television screen immediately after selecting the option.
3. “Daily Contest” means a new Contest which opens each day at 11.00 hrs and closes at 23:59 hrs of the same day
4. “Contest Period”: 14th December, 2011 to 12th January, 2012

1. The Contest is open ONLY to Tata Sky subscribers who have subscribed to the Topper Channel.
2. The Contest is open ONLY to Tata Sky subscribers with an Active account status both at the time of participation and selection.

1. Students studying in 6-12 Standard are eligible to participate in the contest.
2. (i) Tata Sky employees and their relatives; (ii) Tata Sky business associates including its dealers and advertising agencies and its employees; and (iii) anyone else who may be involved with the Contest are in-eligible to participate in this Contest.
3. Tata Sky reserves the right, at any time, to verify eligibility requirements, in any manner deemed appropriate. Only a Valid entry with correct answers to the questions will be eligible for selection for the prize.
4. It is mandatory for you to be eligible to participate in the contest that You must (i) be a resident of India; (ii) be a student studying in 6- 12 standard; (iii) have a Subscriber Account with an Active account status to qualify and participate in the Contest (iv) Should have Topper Channel or have subscribed to Topper channel during the Contest Period. All conditions stated in (i) to (iv) above are complimentary to each other and they must all be fulfilled to participate in the contest.

1. The Contest features one question daily.
2. At the end of the quiz a code will be generated on your TV screen. You must send this code by sms to 56633 and only a Valid entry will be considered. The cost of the sms sent by you shall be the rates as applicable by your service provider
3. The participants, who have answered one or more questions correctly,  will be considered for selecting the winners. The winner will be selected via a random computer generated process, under the supervision of a special panel.
4. The results generated, under the supervision of the special panel will be final and binding.
5.  A participant shall be eligible to win only once during the Contest Period.

1. 3 winners, chosen by the special panel,  will win scholarship of Rs. 1,00,000/- (Rupees One Lakh ) each
2. 20 other winners, chosen by the panel,  will win scholarship of Rs. 5,000/- (Rupees Five Thousand Only) each
3. TDS and or other applicable taxes shall be deductable from the scholarship/prize money.
4. The prize is not exchangeable for any other offer.
5. The winner shall be contacted via phone on the registered number as per Tata Sky records.
6. The winner shall forward to Tata Sky at their registered office, within 7 days of contacting him/her, documents evidencing that the winner is currently studying in 6 – 12 standard particulars of which shall be informed via phone
7. If Tata Sky is not able to contact the winner on the registered phone number or the address as mentioned in Tata Sky records by midnight  within seven days after Tata Sky 's first attempt to notify the winner, Tata Sky  reserves the right to select an alternative winner
8. The scholarship cheque will be sent to the winner via courier by Tata Sky within 30 working days from the date of receipt of the documents, as detailed once the winner is selected.
9. There should be a savings account in the name of the student/winner.
10. Tata Sky shall not be liable for any loss/ theft of the cheque.

1. You can participate in one or all of the Daily Contests.
2. You may send as many entries as you wish.
3. SMS rates will be applicable as per the tariff of Your mobile service provider.
4. For every Valid entry sent, Rs. 0/- will be charged to Your Tata Sky Subscriber Account as participation fee.
5. SMS entries for the Daily Contest sent after the closure of the Daily Contest i.e. after 23:59:59 will not be considered.
6. The winner will be selected after the Contest Period.
7. There shall be only one winner per Subscriber Account.
8. Any participant who manipulates the Contest in any manner whatsoever shall be liable for disqualification at the sole discretion of Tata Sky. In such an event Tata Sky shall not be liable to consider even a Valid entry sent by the participant thereafter.
9. Tata Sky reserves the right at anytime, without prior notice, to add or vary all or any of these terms and conditions or to replace, wholly or in part this Contest or to withdraw it completely.
10. Tata Sky will have the right to use the image of the winners in any promotional material. By entering the Contest, You agree that in the event you are selected as the winner, You shall participate in any promotional activity(ies) and/or have Your name and likeness featured in any promotional material as Tata Sky may require.
11. The payment of the scholarship amount shall be subject to deduction of applicable withholding taxes as per Indian Income Tax Laws.
12. The winner will be responsible for any other relevant taxes arising from the receipt of the prize. You agree to indemnify Tata Sky against any claims incurred by Tata Sky on account of failure on your part to discharge your tax liabilities with respect to the prize.
13. Tata Sky will not be liable for any loss, damage or cancellation of this Contest caused by events beyond its reasonable control including war, natural calamities, floods, failure of telecommunication network, etc.
14. You consent to comply with these terms and conditions and waive any right to claim ambiguity in these terms and conditions and release, indemnify and hold harmless Tata Sky and its respective affiliates, advertising and promotion agencies, and its respective agents, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from participation in the Contest including but not limited to any use or misuse of the prize by the winner.
15. You acknowledge and agree that all disputes in relation to the Contest shall be subject to exclusive jurisdiction of Mumbai Courts.
16. Tata Sky is not responsible for printing or typographical errors in any Contest related materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access any web site associated with this Contest, or process any transaction thereon.
17. The Contest is void where prohibited or restricted by law, and is subject to all applicable mandatory national, state and local laws.
