  1. REFERRAL PROGRAM
    1. Tata Sky Referral Program ('Referral Program') is a reward based referral program for the Subscribers of Tata Sky Limited ('Tata Sky'). Under this program, the Subscribers of Tata Sky who have an Active Account Status and does not fall within the category mentioned in D (1) of the General Terms are eligible to refer a new customer ("New Subscriber") to Tata Sky.
    2. The Referral Program is valid from 10th August 2017 to 31 August 2018, which can be discontinued anytime or extended at the sole discretion of Tata Sky.
    3. The New Subscriber will be contacted by the Tata Sky sales team. Upon the successful activation of the connection of the New Subscriber, the Subscriber will become eligible to a credit of Rs. 300/- as Referral Benefits to his/her Tata Sky Subscription account within one (1) day of such successful activation.
  2. REFERRAL BENEFIT
    Subject to terms and conditions of this Referral program, Referral Benefit shall mean an amount of Rs. 300/- per successful activation of Tata Sky connection of the New Subscriber.
  3. METHODS OF PARTICIPATION
    A Subscriber can refer a new Subscriber to Tata Sky through following modes:
    1. Through SMS: A Subscriber can text: Refer <Mobile Number> to 56633, from his/her RMN (primary/alternate).
      1.         In case the Subscriber has multiple subscriber IDs linked to his/her account: Subscriber will have to indicate the Subscriber ID on which Subscriber would like to receive the Referral Benefit.
    2. Through Interactive Voice Response (IVR): A Subscriber can participate in the Referral Program by dialling a toll-free number 1800 208 7878 from his/her RMN (primary/alternate).
  4. GENERAL TERMS AND CONDITIONS
    1. The following persons shall not be entitled to participate in this Referral Program:
      1. Employees and relatives of the employees of Tata Sky;
      2. Tata Sky business associates including the dealers and advertising agencies;
      3. Anyone who may be involved with the promotion such as content partners, vendors, agencies etc.;
      4. Subscribers who have already received the benefits of this Referral Program for three (3) times during the term of this Referral Program; and
      5. Residents of any state in India, if it is prohibited by law in such state for example, State of Tamil Nadu.
    2. In addition to the terms and conditions stated here, the Subscribers shall be bound by the  terms and conditions stipulated in the Hardware Warranty Terms and Conditions, Specific Terms and Conditions of Tata Sky Subscription Contract and/or Specific Terms and Conditions of Tata Sky Subscription Contract for Tata Sky Hardware provided on Entrustment basis and/or Everywhere TV Terms and Conditions and such other documents, all found on the Tata Sky website - www.tatasky.com. The documents referred above will be collectively referred herein as 'Subscription Contract'.
    3. The Referral Program is valid from 28th May, 2017 until 31 August 2018, which can be discontinued anytime or extended at the sole discretion of Tata Sky.
    4. The Subscriber can refer a New Subscriber starting from 28th May, 2017 at 00:00:00 AM until 23:59:59 PM 31 August 2018 only.
    5. Tata Sky reserves the right, at any time, to verify eligibility requirements, in any manner deemed appropriate by Tata Sky.
    6. Only a Subscriber of Tata Sky having an active account status can refer a new Subscriber under this Referral Program.
    7. An existing Tata Sky Subscribers (Active/In-active) will not be considered as a new customer.
    8. Only Regular-Residential category subscribers can refer a New Subscriber. Any reference from any Tata Sky employee, agent, dealer, installer, etc. will not be considered as reference.
    9. A Subscriber can refer a New Subscriber only by sharing the 10-digit mobile number of the new Subscriber. The Subscriber has to do so through his/her RMN (primary or alternate).
    10. The New Subscriber will be informed that he/she has been referred by a Tata Sky Subscriber (subscriber's name will be shared with such New Subscriber).
    11. Any New Subscriber can be referred only once. A second referral of the same New Subscriber will not be accepted as a New Subscriber.
    12. Upon the successful activation of the Tata Sky connection of the New Subscriber, the Subscriber will become eligible to receive a credit of Rs. 300/- to his/her Tata Sky Subscription account one (1) day post activation of Tata Sky connection of the New Subscriber.
    13. The said Referral Benefit shall only be a one-time credit and shall not be considered as a recurring monthly credit. Tata Sky reserves the right to increase or decrease the amount of the said Referral Benefit anytime during the Term of this Referral Program without any prior intimation to its Subscribers.
    14. A Subscriber can refer up to a maximum of hundred (100) new Subscribers, however, the Subscriber can receive the Referral Benefits to his/her Tata Sky Subscription Account for only three (3) successful activation of the new Subscribers referred by him/her. For avoidance of any doubt, a Subscriber will not receive any Referral Benefits any referrals beyond three (3) successful New Subscriber activations of the Tata Sky connection referred by him/her.
    15. Subject to point 11 above, if a Subscriber is a Long Duration Pack ('LDP') Subscriber, he/she will still receive Rs.300 in account balance per new referred Subscriber, however, the Referral Benefits will not be extended to the duration of their LDP. In such an event the LDP Subscriber can use such credit in his/her Tata Sky Subscription account for accessing Tata Sky value added services and/or platform services such as watching movie on showcase, Pay per view etc.
    16. This Referral Program is non-transferable, not for resale, and not redeemable for cash.
    17. A Subscriber will be eligible for the Referral Benefit if the New Subscriber referred by the Subscriber activates the new connection through online/helpline modes only.  Referral benefits will not be provided if the New Subscriber gets the new connection through any other sales channels.
    18. The Subscriber having multiple Subscription account linked to his/her RMN, can receive the Referral Benefits credit in only one Subscription account provided by him/her at the time of referring the New Subscriber.
    19. Tata Sky reserves the right at any time, without prior notice, without assigning any reason and without any liability whatsoever, to add or vary all or any of the terms and conditions or to replace, wholly or in part this Referral Program or to withdraw it completely or to change the composition of Referral Program.
    20. All taxes and/or levies applicable in relation to the Referral Program shall be solely borne by the existing Subscribers.
    21. The charges for SMS sent by the Subscriber for the participation in this Referral Program shall be solely borne by the Subscriber as per the rates and charges applicable by the Subscriber's respective telecom network provider.
    22. Tata Sky reserves the right to reverse Referral Benefit amount mistakenly credited to the Subscriber's Tata Sky Subscription account.
    23. The Subscriber hereby declare that they obtained due consent from the new Subscriber to provide their contact details to Tata Sky Limited, and that Tata Sky Limited may contact them to offer its products and/or services. The Subscriber shall be responsible to Tata Sky Limited, for any losses or claims that may be occasioned upon Tata Sky Limited, in the event that this declaration is found to be untrue.
    24. Tata Sky will not be responsible for any loss or damage caused to the Subscribers if the Referral Program is cancelled and/or withdrawn by Tata Sky or if the Subscriber is not able to Participate in the Referral Program due to a Force Majeure Event including without limitation for reasons beyond the reasonable control of Tata Sky such as war, natural calamities, floods, failure of telecommunication network, satellite technology failure etc.
    25. By participating in this Referral Program, it shall be deemed to be construed that the Subscribers have read and consented to the terms and conditions stated here in and in the Subscription Contract.
    26. The Subscribers and/or any person through the Subscribers shall waive any and all right that such an individual may have to claim ambiguity in these terms and conditions and agrees to release, indemnify and hold harmless Tata Sky and its respective affiliates, advertising and promotion agencies, and its respective agents, partners, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from the Subscribers participating in this Referral Program.
    27. Tata Sky shall not be responsible for printing or typographical errors in any promotional materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access the Tata Sky website or process any transaction thereon.
    28. All capitalized terms used herein shall have the same meaning as ascribed to them in the Subscription Contract.
    29. In the event of any inconsistency between the Subscription Contract and these Terms and Conditions, in so far as this Referral Program is concerned, the latter shall prevail.
    30. Headings used herein are for convenience only and do not affect the interpretation of this Referral Program Document.
    31. The Referral Program shall be construed in accordance with the laws of India and the courts of New Delhi shall have the sole and exclusive jurisdiction to adjudicate on any disputes arising from this Referral Program.

ONLINE REFERRAL PROGRAM

Following are specific terms and conditions of the Online Referral Program.

  1. The Online Referral Program is valid from 10th August, 2017 to 31 August 2018, which can be discontinued anytime or extended at the sole discretion of Tata Sky.
  2. Upon the successful activation of the connection of the New Subscriber, the Subscriber will become eligible to a credit of Rs. 300/- as Referral Benefits to his/her Tata Sky Subscription account within one (1) day of such successful activation.

METHODS OF PARTICIPATION

A Subscriber can refer a new Subscriber to Tata Sky through following mode:

  1. Through Tata Sky website: A Subscriber can visit www.tatasky.com/refer to participate in the Referral program.
  2. In case the Subscriber has multiple subscriber IDs linked to his/her account: Subscriber will have to indicate the Subscriber ID on which Subscriber would like to receive the Referral Benefit.

SPECIAL TERMS AND CONDITIONS

  1. The Online Referral Program is valid from 10th August, 2017 to 31 August 2018, which can be discontinued anytime or extended at the sole discretion of Tata Sky.
  2. The Subscriber can refer a New Subscriber starting from 10th August, 2017 at 00:00:00 AM.
  3. The New Subscriber will be informed that he/she has been referred by a Tata Sky Subscriber through Email, SMS (subscriber's name will be shared with such New Subscriber).
