Tata Sky Zeetos Rewards Programme

  • Tata Sky Zeetos Rewards Programme ("Programme") is a loyalty programme offered on the Tata Sky DTH platform.
  • Tata Sky subscribers (“You”) can participate in the Programme by redeeming Zeetos for:
    • Toys/Merchandize
    • In-game power ups on the In Game Shop
  • You can participate in the Programme either: (i) through the Zeetos Rewards Program section on the Tata Sky interactive platform services section or (ii) through Tata SkyTata Sky  English or Tata SkyTata Sky Fun Learn or Tata SkyTata Sky Smart Games or Tata Sky Dance Studio interactive platform services section; on the Tata Sky DTH platform.
  • Tata Sky subscribers participating in the Programme shall be bound by the following terms and conditions:
  • Definitions
    • Zeetos Rewards Programme Member (ZRPM): is a Tata Sky subscriber who has subscribed to the Tata SkyTata Sky Fun Learn Pack or Tata SkyTata Sky English Pack or Tata SkyTata Sky Smart Games Pack or Tata Sky Dance Studio or Combo Tata SkyTata Sky English Fun Learn Pack or Super Value English Special Pack or the Super Value Kids Special Pack or the Mega Pack & any of its versions or any pack that has Tata SkyTata Sky Fun Learn Pack or Tata SkyTata Sky English Pack or Tata SkyTata Sky Smart Games Pack  or Tata Sky Dnace Studio.Membership to the Zeetos Reward Programme is automatic and participation in the Programme is voluntary
    • Zeetos: are the loyalty points that the ZRPMs accumulate each time the ZRPMs participate in specific activities that offer earning Zeetos through Tata SkyTata Sky English or Tata SkyTata Sky Fun Learn or Tata SkyTata Sky Smart Games or Tata Sky Dance Studio on the Tata Sky interactive platform services section.
    • Toys/Merchandise Store:  is the listing of the Toys/Merchandize on the Zeetos Rewards Program section on the Tata Sky interactive platform services section.
    • Toys/Merchandise: are the products (listed under the Toy/Merchandise Store section of the Programme) that a ZRPM can redeem his Zeetos for.
    • Zeetos enabled game: a game on Tata SkyTata Sky Smart Games that provides the opportunity to earn/ redeem zeetos
    • In-Game Shop: are exchange shops inside Zeetos enabled games where the ZRPM can redeem zeetos for  Powerups/In-Game Items.
    • Powerups/In-Game Items: are specific items available for exchange on zeetos enabled games.
    • Active account status: means a positive account balance in your Subscriber Account.
    • SMS: means a code sent via  sms by ZRPM in the correct prescribed format to 56633.
    • Processing fee: is an amount charged to the ZRPM for processing a valid redemption of a Toy/Merchandise on the Zeetos Rewards Programme. This amount is deducted from the ZRPM’s account against sending a valid SMS for redemption of a Toy/Merchandise.
    • Financial Year: A financial year is from 1st of April to 31 of March.
  • Terms used herein but not defined shall have the same meaning as assigned to them in the Subscription Contract signed between You and Tata Sky. 
  • Programme Period
    • 1.Programme shall start on 5 July 2010 and remain valid till withdrawn.
  • Eligibility
    • The Programme is open ONLY to ZRPMs during the validity of the subscription period of their Tata Sky Fun Learn Pack or Tata Sky English Pack or Tata Sky Smart Games Pack or Combo Tata Sky English Fun Learn Pack or Super Value English Special Pack or the Super Value Kids Special Pack or the Mega Pack & any of its versions or any pack that has Tata Sky Fun Learn Pack or Tata Sky English Pack or Tata Sky Smart Games Pack .
    • The following persons cannot participate in this Programme:
      • Employees of Tata Sky and their relatives
      • Tata Sky business associates including its dealers and advertising agencies and
      • Anyone else who may be involved with the Zeetos Rewards Programme.
      • Tata Sky reserves the right, at any time, to revise eligibility requirements, in any manner deemed appropriate, without any prior intimation.
      • ZRPM must (i) be a resident of India (ii) be above 18 years of age (iii) have a valid PAN card and (iv) have a Subscriber Account with an Active account status to qualify and participate in the Programme.
  • Redemption of Zeetos against Toys/Merchandise
    • The list of Toys/Merchandise that can be redeemed will be listed on the Zeetos Rewards Program section of the Tata Sky interactive platform services section.
    • The ZRPM must follow the below steps for making a “Valid redemption of Toys/Merchandise”:
      • Go to the Zeetos Rewards Program service through the Tata Sky menu on the Tata Sky Interactive services platform.
      • Go to the Toys/Merchandise store by pressing the Green button on the Remote.
      • ZRPM has to select the toy he wishes to redeem by pressing the Select key on the Remote.
      • ZRPM has to send the code displayed on screen as an SMS to 56633.
    • Valid redemption of Toys/Merchandise would be limited to one valid request per day.
    • For every Valid redemption of Toys/Merchandise there will be deduction of requisite Zeetos from the ZRPM’s account and a processing fee will be charged to the ZRPM’s Subscription Account; the processing fee may differ for different Toys/Merchandise or be changed without prior notice by Tata Sky.
    • The ZRPMs who have sent a Valid redemption of Toys/Merchandise shall be contacted via phone for verification at the phone number mentioned in the Subscription Contract. ZRPMs must allow 60 days for delivery after the details have been verified to the satisfaction of Tata Sky.
    • If Tata Sky or a Tata Sky representative does not contact the ZRPM who has participated in the Programme within 30 days from the date a Valid redemption of Toys/Merchandise was made, the ZRPM can contact Tata Sky on the Tata Sky helpline.
    • By participating in this Programme, You agree that you shall not hold Tata Sky liable for any defect or deficiency in any Toys/Merchandise or for any damage caused to the Toys/Merchandise during delivery or for delayed delivery. In case of any complaints pertaining to the Toys/Merchandize, You can contact the Tata Sky helpline. Tata Sky shall endeavour to resolve your complaints without being held liable for any of them.
  • Redemption of Zeetos against In-Game Items/Powerups
    • The list of Powerups/In-Game items that can be redeemed will be available and listed only inside Zeetos enabled games.
    • For a Valid redemption of In-Game Items/Powerups as specified in point 3 below, the ZRPM should be subscribed to Tata Sky Smart Games Pack or the Mega Pack & any of its versions or any pack that has Tata Sky Smart Games Pack.
    • ZRPM must follow either of the cases below for a “Valid redemption of In-Game Items/Powerups”:
      • Case 1:
        • Inside the In-Game shop select the Item you wish to purchase.
        • Upon purchase, a popup will be shown to confirm the purchase with the requisite amount of Zeetos.
        • Follow the instructions on the popup to confirm the purchase.
      • Case 2:
        • Revival popup appears when the player dies.
        • To revive, the player must confirm the purchase of revival by exchanging Zeetos.
        • Follow the instructions on the popup to confirm the purchase.
  • Earning of Zeetos:
    • Zeetos can be earned  when the ZRPMs participate in specific activities that offer earning Zeetos  on Tata Sky English, Tata Sky Dance Studioand Tata Sky Fun Learn and submit their system generated game score/correct answer to the quiz/story questions/games on the Tata Sky interactive platform services section wherever necessary.
    • Zeetos can be earned when the ZRPMs complete levels or pre-defined activities inside Zeetos enabled games on Tata Sky Smart Games section on Tata Sky interactive platform services section.
    • For details on how to earn Zeetos daily, ZRPM must refer to the help section on the Zeetos Rewards Program section of the Tata Sky interactive platform services section.
    • ZRPM will need to refer the Zeetos earned section on the top left hand side space on the Zeetos Rewards Program section to know his current/available Zeetos balance.
    • The Zeetos can be earned on both Your Primary Digicomp as well as Your MultiTV connection. However, the points earned on different digicomps will not be considered cumulative on redemption.
    • If Your Digicomp would need to be replaced or repaired, you acknowledge and agree that on account of system and technology constraints, your Zeetos balance shall automatically become Nil and You shall be deemed to have forfeited any Zeetos balance in your ZRPM Subscriber account.  You further agree that you shall not hold Tata Sky liable in such an event.

General

  • Tata Sky reserves the right, at anytime without prior notice, without assigning any reason and without any liability whatsoever, to add or vary all or any of these terms and conditions or to replace wholly or in part this Programme or to withdraw it completely or to change the composition of this Programme.
  • Tata Sky reserves the right, at anytime without prior notice, to:
    • Change the Toys/Merchandise on the Zeetos Rewards Programme service on Tata Sky interactive services platform, without prior notice.
    • Change the processing fee for Toys/Merchandise on the Zeetos Rewards Programme service on Tata Sky interactive services platform, without prior notice.
    • Change the requisite number of Zeetos required for a Valid redemption of Toys/Merchandise or a Valid redemption of In-Game Items/Powerups, without prior notice.
  • ZRPM should have the requisite amount of Zeetos required in his account to make a redemption.
  • ZRPM can redeem Zeetos for Toys/Merchandise a maximum of six (6) times in a Financial year.
  • Tata Sky will have the right to use the image of the ZRPMs in any promotional material. By entering the Programme, You agree that You shall participate in any promotional activity(ies) and/or have Your name and likeness featured in any promotional material as Tata Sky may require.
  • Zeetos are non-transferable.
  • Zeetos cannot be exchanged for cash.
  • In case the ZRPM chooses to cancel or fails to renew his subscription to the Tata Sky Fun Learn Pack or Tata Sky English Pack or Tata Sky Smart Games Pack or Tata Sky Dance Studio or Combo Tata Sky English Fun Learn Pack or Super Value English Special Pack or the Super Value Kids Special Pack or the Mega Pack & any of its versions or any pack that has Tata Sky Fun Learn Pack or Tata Sky English Pack or Tata Sky Smart Games Pack, then the Zeetos accumulated by ZRPM shall be reduced by 50% from the total Zeetos accumulated by ZRPM till the date of such cancellation or expiry.In addition to the terms and conditions stated here, the Tata Sky subscribers shall be bound by the  terms and conditions stipulated in the Subscription Contract and such other documents, all found on the Tata Sky website - www.tatasky.com. 
  • Tata Sky shall not be responsible in case of any network problems such as breakdown of machinery, unclear network, disruption in the network and/or the charges that may be payable by the Tata Sky subscribers to any network operator or network service provider including any mobile carrier handling charges, data handling charges, or premium rates that may be charged by the network operator/ service provider. Tata Sky subscribers must check with their respective network operators regarding the charges payable to the network operator before using any of the methods mentioned above.  Any dispute about the same should be settled between the Tata Sky subscribers and the network operator without involving Tata Sky.
  • Any and all taxes and/or levies applicable in relation to the Programme shall be solely borne by Tata Sky subscribers. Any applicable network capacity fee (NCF) shall also be borne by the Tata Sky subscribers.
  • Tata Sky will not be liable for any loss, damage or cancellation of this Programme caused by force majeure events beyond its reasonable control of Tata Sky including war, natural calamities, floods, epidemics, pandemics, failure of telecommunication network, etc.
  • You consent to comply with these  terms and conditions and waive any right to claim ambiguity in these terms and conditions and release, indemnify and hold harmless Tata Sky and its respective affiliates, advertising and promotion agencies, and its respective agents, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from participation in the Programme including but not limited to any misuse of the Toys/Merchandize.Any disputes, differences or questions, which may arise at any time hereafter between Tata Sky and the Tata Sky subscribers touching the true construction of this Agreement or performance of the obligations or enforcing any rights and/or liabilities of the Parties hereunder, shall be first amicably resolved between the Parties within 30 (thirty) days from the date on which such dispute was raised by a Party and communicated to the other Party in writing failing which the dispute shall be referred to a sole arbitrator of the Indian Council of Arbitration (ICA). The arbitration shall be conducted in accordance with the Rules of Arbitration of the Indian Council of Arbitration and shall be subject to the provisions of the Arbitration and Conciliation Act, 1996, as amended or any statutory modifications or re-enactment thereof for the time being in force. The venue of such arbitration shall be at Mumbai and the Courts at Mumbai alone shall have exclusive jurisdiction to deal with the arbitration proceedings and the awards in accordance with law. The arbitration proceedings shall be conducted in English language. The award passed by the arbitrators shall be final and binding upon the Parties.
  • Subject to the arbitration clause, these terms and conditions shall be construed and governed by the laws of India and the Parties agree to submit to the sole and exclusive jurisdiction of the courts of Mumbai.
  • Tata Sky is not responsible for printing or typographical errors in any Programme related materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error.
  • The Programme is void where prohibited or restricted by law, and is subject to all applicable mandatory national, state and local laws.
