Tata Sky Packs and Offers

OFFER

  1. This Welcome Offer (‘Offer’) is a promotional scheme which is being offered by Tata Sky Limited (‘Tata Sky’) and Reliance Big Tv Limited [Reliance Digital Tv].  
  2. Under this Offer, a subscriber of Reliance Digital Tv shall be entitled to the following:
    1. A Tata Sky Connection at no additional charges. The Tata Sky Connection that can be availed by the subscriber of Reliance Digital Tv is either the Tata Sky Standard Definition Connection or the Tata Sky High Definition Connection as may be elected by the subscriber of Reliance Digital Tv. If the subscriber of Reliance Digital Tv has a Multi tv DTH Connection with of Reliance Digital Tv, then such a subscriber could also opt for a Multi Tv Tata Sky Connection at no additional charges subject to maximum 3 Tata Sky Connection i.e. [1 Primary Tata Sky Connection and 2 Secondary Tata Sky Connection].
    2. Credit apportionment in the new Tata Sky Subscription account of the same credit balance that the subscriber of Reliance Digital Tv had under its previous Reliance Digital Tv Subscription Account, within 7 working from the date activation of the new Tata Sky Subscription account . The Credit Apportionment cannot be encashed by the subscriber of Reliance Digital Tv and will not be refunded by Tata Sky.  
  3. The Offer Period begins on October 26, 2017 and ends on December 31, 2017. To be eligible for the Offer, the participant must be an active direct to home subscribers of the Reliance Digital Tv (‘Eligible Participant’) in the records of Reliance Digital TV on October 26, 2017. To prove the eligibility, the Eligible Participant(s) must provide Tata Sky the following information (together with proofs) so that Tata Sky can verify these details with Reliance Digital Tv:
    1. Reliance Digital Tv Subscription Account 
    2. Name of the Eligible Participant(s) as registered in the records of Reliance Digital Tv
    3. The registered mobile number of the Eligible Participant(s) as registered in the records of Reliance Digital Tv.
    4. Details of the Reliance Big Connection availed by the Eligible Participant(s) such as viewing card number/Smart Card Number allotted at the time of Reliance Big Connection.
  4. Notwithstanding anything to the contrary stated herein, it is clarified that all the information provided by the Eligible Participant(s) to Tata Sky, to prove its eligibility as stated above, must match the records of the Reliance Digital Tv failing which Tata Sky reserves the right to not give this offer to the persons desirous of availing this offer. Further, if in future after availing this Offer, it is found that the participants were illegible for this Offer, Tata Sky reserves the rights to immediately withdraw the Offer and charge the participants the rates that are applicable to the new subscribers on the date on which the participant are wrongly availed this Offer from Tata Sky.
  5. To avail the Offer the Eligible Participant(s) must follow the following steps:
    1. Step 1 -           After familiarizing themselves with these terms and conditions, the Eligible Participant(s), within the Offer Period, must give a missed call on 92370 92370.  
    2. Step 2 – Upon receiving the missed call, Tata Sky will arrange for a customer care executive to call the Eligible Participant(s) on the same number from which the Eligible Participant(s) has given a missed called to Tata Sky. The customer care executive shall attempt to reach out to the Eligible Participant(s) twice and if the Eligible Participant(s) fails to take the calls made by the customer care executive, then Tata Sky reserves the right not to further pursue the request made by the Eligible Participant(s).  
    3. Step 3 - Upon the Eligible Participant(s) sharing the complete details as may be sought by the customer care executive, the customer care executive will lodge the order placed by the Eligible Participant(s) for a Tata Sky Standard Definition Connection or the High Definition Connection or Multi Tv Tata Sky Connection and will inform Tata Sky of the same.
    4. Step 4 - Upon receiving an order for the Tata Sky Connection or Multi Tv Tata Sky Connection, Tata Sky shall make arrangements for installation of the Tata Sky Hardware at the premises of the Eligible Participant(s). Tata Sky Hardware shall consist of one Standard Definition Set Top Box or one High Definition Set Top Box (as the case may be), minidish, LNB, cable, connector(s) and related parts and digicard. In case of Multi Tv Tata Sky Connection, the Tata Sky Hardware shall consist of the number of Standard Definition Set Top Box or High Definition Set Top Box corresponding to the Tata Sky connection order by the Eligible Participant(s).
    5. Step 6 – Simultaneously, upon placing an order with the customer service executive, the Eligible Participant(s) must also select an Package(s) available on www.tatasky.com starting from Rs. 199 per month. Depending on the Package(s) chosen by the Eligible Participant(s), the Eligible Participant(s) must pay Tata Sky as per applicable price for the selected pack. Similarly, any subscription for ad-on pack and/or Tata Sky Services can be subscribed by the subscriber on the payment of the applicable prices as are prevailing at the time of selection.
    6. Step 7 – Before the Tata Sky Hardware  is installed in the premise of the Eligible Participant(s), the Eligible Participant(s) must (i) select a package of their choice and pay the subscription fee at the applicable charges for the package so selected by the Eligible Participant(s) and (ii) Deposit/return to Tata Sky all the existing Reliance Digital Tv Set Top Box(es) together with the Smart Card  that may have been provided to Eligible Participant(s) at the time of installation of the Reliance Digital Tv Set Top Box(es).
  6. The Tata Sky Connection will be activated only after the charges mentioned in point 1.5.5 (i) is received by Tata Sky from the Eligible Participant(s) and the existing Reliance Digital Tv Set Top Box is returned to Tata Sky as stated in clause 1.5.5 (ii) above. The aforesaid conditions are the essence of this Offer and Tata Sky reserves the right to cancel/withdraw the Offer to the Reliance Digital Tv Subscriber and not deliver the Tata Sky Hardware to the Eligible Participant(s).
  7. The Eligible Participant(s) new Tata Sky Subscription Account will be credit with the same account balance that the Eligible Participant(s) had under its previous Reliance Digital Tv Subscription Account as stated in point 1.2.2, only after Tata Sky has received the information from Reliance Digital Tv. The details given by Reliance Digital Tv regarding the credit balance shall be final and Tata Sky shall not be responsible to verify the same. In the event, the Eligible Participant(s) needs any information on this credit balance or is desirous of reconcile the same, then the Eligible Participant(s) must directly contact Reliance Digital Tv.  Any dispute, complaint and disagreement that the Eligible Participant(s) may have against Reliance Digital Tv must be directly dealt with between the Eligible Participant(s) and Reliance Digital Tv and Tata Sky shall not be responsible for the same.
  8. The Eligible Participant(s) must not only agree to these terms and conditions specifically associated with the Offer but also agree to the  terms and conditions stipulated in the, Specific Terms and Conditions of Tata Sky Subscription Contract and/or Specific Terms and Conditions of Tata Sky Subscription Contract for Tata Sky Hardware provided on Entrustment basis and/or Everywhere TV Terms and Conditions, all found on the My Tata Sky website - www.mytatasky.com. The documents referred above will be collectively referred herein as ‘Subscription Contract’. The Subscription Contract governs the relationship between Tata Sky and the subscriber and therefore, once the Eligible Participant(s) becomes a subscriber of Tata Sky, then all the terms and conditions in the Subscription Contract will apply.
  9. The Tata Sky Hardware and/or the Tata Sky Service and/or the Tata Sky High Definition Connection can be availed only in India. The Tata Sky Hardware and any hardware installed by Tata Sky at the premises of the Eligible Participant(s) has been provided to the Eligible Participant(s) on an entrustment basis, without any consideration, only to avail of the Direct to Home Service of Tata Sky during the validity of the Subscription Contract.
  10. As the Tata Sky Hardware has been provided on entrustment basis, it cannot be construed that any rights in the Tata Sky Hardware or otherwise of whatsoever nature has been transferred by Tata Sky to the Eligible Participant(s) or any persons availing the services through the Eligible Participant(s). Tata Sky reserve the right to repossess the Tata Sky Hardware and/or claim damages from Eligible Participant(s) for any loss or unauthorized use or damage to the Tata Sky Hardware or if the Tata Sky Hardware is stolen during the period it has been provided to Eligible Participant(s) on an entrustment basis or in the event of the failure of the Eligible Participant(s) to return the Tata Sky Hardware immediately upon cancellation or termination of the Service. Any reference to the Tata Sky Hardware in this Terms and Conditions shall include the complete Tata Sky Hardware or its parts thereof.

STANDARD TERMS AND CONDITIONS

  1. Offer cannot be combined with, and is not valid with, any other rebates, offers, discounts, promotion or programs. This Offer is nontransferable, not for resale, and not redeemable for cash.
  2. Upon the expiration of the Offer Period, the subscription fee for the HD Access Fee will be charged to the Tata Sky Subscription Account of the Eligible Participant unless to timely cancel the HD Service before the expiration of the Promotional Waiver Period. It is clarified that the Eligible Participant shall not be informed that the Promotional Waiver Period will end or has ended and if the Eligible Participant fails to discontinue the HD Services, Tata Sky will charge and collect the recurring HD Access Fee on monthly basis.
  3. Tata Sky is not responsible for any concerns that the Eligible Participant(s) may have against Reliance Digital Tv or any disagreement/dispute that may have arisen between Eligible Participant(s) and Reliance Digital Tv during the period when the Eligible Participant(s) was a subscriber of the Eligible Participant(s). Any dispute, complaint and disagreement that the Eligible Participant(s) may have against Reliance Digital Tv must be directly dealt with between the Eligible Participant(s) and Reliance Digital Tv and Tata Sky shall not be responsible for the same. The Eligible Participant(s) must directly contact Reliance Digital Tv or its authorized dealers for any information and/or complaint related to their subscription with Reliance Digital Tv.
  4. Tata Sky expressly disclaims any responsibility and the Eligible Participant(s) and all participants availing this Offer through the Eligible Participant(s) agrees to hold Tata Sky harmless from all liabilities for any costs, claims, damages or any other injury (whether due to negligence or otherwise), disability or loss to any person or property due in whole or in part, directly or indirectly, to participation in the Offer, the delivery and/or subsequent acceptances of, use or misuse of any Offer, or Offer related activity.  Tata Sky is not responsible for any loss (financial or otherwise), liability, injury (including death) or damage to persons or property, which may be caused directly or indirectly, in whole or in part, by the purchase of, use or misuse of any Offer related product. Tata Sky further assume no liability either for the cancellation, modification or premature conclusion of the Offer for any reason or through the acts or defaults of any company or person providing any Offer or due to weather, fire, strike, acts of war or terrorism, or any other condition beyond its control (a ‘Force Majeure Event’).
  5. Tata Sky shall not be responsible in case of any network problems such as breakdown of machinery, unclear network, disruption in the network and/or the charges that pay be payable by the subscriber to any network operator. Any dispute about the same should be settled between the Eligible Participants and the network operator without involving Tata Sky.
  6. The Eligible Participant(s) must provide all the required information, which may be asked from the Eligible Participant(s).
  7. Tata Sky reserves the right at any time, without prior notice, without assigning any reason and without any liability whatsoever, to add or vary all or any of the terms and conditions or to replace, wholly or in part this promotional scheme or to withdraw it completely. Tata Sky will not be responsible for any loss or damage caused to the Eligible Participant(s) if the Offer is cancelled and/or withdrawn by Tata Sky or if the Eligible Participant(s) is not able to view channels due to a Force Majeure Event including without limitation for reasons beyond the reasonable control of Tata Sky such as war, natural calamities, floods, failure of telecommunication network, satellite technology failure etc.
  8. Any and all taxes and/or levies applicable in relation to the Offer shall be solely borne by the Eligible Participant(s). By availing this Offer, it shall be deemed to be construe that the Eligible Participant(s)  has read and consented to the terms and conditions stated here in and in to the Subscription Contract.
  9. The Eligible Participant(s)  and/or any person through the Eligible Participant(s)  waives any and all right that such an individual may have to claim ambiguity in these terms and conditions and agrees to releases, indemnifies and hold harmless Tata Sky and its respective affiliates, advertising and promotion agencies, and its respective agents, partners, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from the Eligible Participant(s)  availing this Offer.
  10. Tata Sky shall not be responsible for printing or typographical errors in any promotional materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access the Tata Sky website or process any transaction thereon.
  11. All capitalized terms used herein shall have the same meaning as ascribed to them in the Subscription Contract. In the event of any inconsistency between the Subscription Contract and these Terms and Conditions, in so far as this Offer is concerned, the later shall prevail. Headings used herein are for convenience only and do not affect the interpretation of this Offer Document.
  12. The Offer shall be construed in accordance with the laws of India and the courts of New Delhi shall have sole and exclusive jurisdiction to adjudicate on any disputes arising from the Offer.
